Welcome to Morph. These Terms of Service ("Terms") govern your use of the Morph mobile application ("App") operated by Tanmay ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account or using Morph, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Morph is an AI-powered fitness and nutrition tracking application that provides:

• Personalized workout planning and logging
• Meal tracking and macro calculation
• AI-powered fitness coaching and recommendations
• Restaurant suggestions based on your dietary needs
• Integration with Apple HealthKit
• Social features for sharing workouts and recipes with friends
• Progress tracking and analytics

3. User Accounts

Account Creation

To use Morph, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Restrictions

• You must be at least 13 years old to create an account
• One account per person is permitted
• You may not share your account credentials with others
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any laws
• Share content that is abusive, harmful, threatening, or harassing
• Post inappropriate, offensive, or objectionable content
• Impersonate any person or entity
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to send spam or unsolicited communications
• Scrape, harvest, or collect data from the App without permission

5. Health Disclaimer

By using this App, you acknowledge and agree that:

• You should always consult with a qualified healthcare provider before starting any new exercise program, diet, or fitness regimen
• You should seek medical attention if you experience any pain, discomfort, or adverse health effects
• AI-generated suggestions and recommendations are for informational purposes only and may not be suitable for your specific health conditions
• We are not responsible for any injuries, health issues, or adverse effects that may result from following workout or nutrition plans in the App
• If you have any medical conditions, physical limitations, or health concerns, you should consult a physician before using this App
• You use the App and follow any suggestions at your own risk

6. Intellectual Property

Our Content

The App, including its design, code, graphics, logos, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

User Content

You retain ownership of content you create in the App, such as workout logs, custom recipes, and personal notes. By sharing content with other users, you grant us a non-exclusive, royalty-free license to display that content within the App's social features.

7. Third-Party Services

Morph integrates with various third-party services including:

• Apple HealthKit
• AI services (OpenAI, Anthropic)
• Google Places API
• Push notification services

These third-party services have their own terms of service and privacy policies. We are not responsible for the practices of these third parties. Your use of third-party services is at your own risk.

8. Subscription and Payments

Some features of Morph may require a paid subscription. If you purchase a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• No refunds will be provided for partial subscription periods

9. Termination

By You

You may delete your account at any time through the App settings. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.

By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the App
• Fraudulent or illegal activity
• Extended periods of inactivity

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER

11. Indemnification

You agree to indemnify and hold harmless Morph and its developer from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Sending you a notification or email
• Updating the "Last Updated" date at the top of this page

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the United States.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Morph regarding your use of the App and supersede any prior agreements.
